Dimension of justice of restoration justice paradigm in the criminal system for sexual violence in Indonesia

The act of sexual violence is a crime that classified as violation human rights (HAM). increase in cases the world, including Indonesia, shows this existing justice system unable to guarantee for victims, and most importantly recovery victims. For reason, restoration approach needed an alternative law enforcement against crimes. In practice, marriage used way restoration. This article uses normative juridical discuss on crimes through approach. It can be concluded must look at criminological, victimological ontological aspects, order able place problem objectively. As complaint offense, may not passed criminal process, if there peace between victim perpetrator, provided agreement victim, family community without coercion from various parties. main thing provide protection assistance victims parties, so separated trauma or psychological impact caused by experienced received after occurrence crime.
